O R D E R

Aggrieved by the inaction of the respondents in taking appropriate action on the representations of the petitioners' dated 26.07.2018, 22.08.2019 and 21.09.2019, for conducting survey and demarcation of the subject land, the present writ petition is filed.

Heard the learned counsel for the petitioners and the learned Assistant Government Pleader for Revenue.

Averments made in the affidavit filed in support of the writ petition goes to show that there is a civil dispute between the petitioners and the unofficial respondent No.5, and as rightly contended by the leaned Assistant Government Pleader for Revenue, petitioners are merely seeking for a direction to the respondents to consider their representations, which in fact, amounts to interfering in a civil dispute between the parties. The contents in the representations referred to above, also disclose that there is a civil dispute between the parties, for which the petitioners have to avail the common law remedy instead of invoking the writ jurisdiction of this court under Article 226 of the Constitution of India, wherein this court cannot go into the disputes questions of fact and decide title and other rights of the parties. Hence, the writ petition is dismissed, leaving it open to the petitioners to avail alternative remedies available under law. Interlocutory applications pending, if any, shall stand closed. No order as to costs.
