HON'BLE SRI JUSTICE S.V. BHATT W.P. No.28758 OF 2017 ORDER:

Heard Mr.K.S.Murthy for petitioner and Mr.Subba Rao for 4th respondent.

The following order is passed with the consent of learned counsel appearing for the parties having regard to the legal and factual objections raised by 4th respondent.

1) The petitioner and the 4th respondent are given liberty to work out the right of custody of the children (1)Deshik Smaran and Vojhal Keerthan before the competent court in accordance with law including claim of transfer certificates.

2) The wards since have continued to study in Delhi Public School, Nacharam, Secunderabad/ 3rd respondent, the period so studied pursuant to interim order with the disposal of this writ petition ought not to be disturbed. This Court has not examined the merits of the rival claims of petitioner and 4th respondent. The continuation of wards in custody or in a school would be dependent on the orders the parties obtained in this behalf from the court of competent jurisdiction. The writ petition is disposed of accordingly. No order as to costs.
