Respondent/Complainant Petition under Section 438 of Cr.P.C. praying that in the circumstances stated in the grounds filed herein, the High Court may be pleased to release the petitioner on anticipatory bail in the event of his arrest in FIR.No. 778/2017 dt. 09-11-2017 registered by P.S. Kushaiguda, Rachakonda, R.R.District. The Petition coming on for hearing, upon perusing the petition and the grounds filed herein and upon hearing the arguments of Sri R.Dheeraj Singh, Advocate for the Petitioner and of the Public Prosecutor (TG) for the Respondent, the Court made the following ORDER:
" This petition is filed seeking for grant of anticipatory bail to the petitioner, who is A2, in Crime No.778 of 2017 on the file of Kushaiguda Police Station, Rachakonda, Ranga Reddy District. The offences alleged are under Sections 406 and 420 IPC.

Heard the counsel for the petitioner and the Public Prosecutor appearing for the respondent.

A perusal of the report shows that the allegation against this petitioner is that the accused No.1, who is the son of this petitioner, introduced him to the defacto complainant, claiming him to be an army officer and later he came to know that the father of the 1st accused is not army officer. Except the above allegation and the allegation that A1 was encouraged by this petitioner, there is no other allegation against this petitioner.

Hence, considering the above circumstances, this court opines that this is a fit case for granting anticipatory bail.

Accordingly, the Criminal Petition is allowed. The petitioners are directed to surrender before the Station House Officer, Kushaiguda Police Station, Rachakonda, Ranga Reddy District, within 15 days from the date of this order. On such surrender, the petitioners shall be released on bail on their executing personal bonds for a sum of Rs.20,000/- (Rupees twenty thousand only) each with two sureties each for a like sum each to the satisfaction of the said Station House Officer. Further, on such release, the petitioners shall abide by the conditions mentioned under Section 438(2) Cr.P.C., as under: (i) The petitioners shall make themselves available for interrogation by a police officer as and when required. (ii) The petitioners shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer;
(iii) The petitioners shall not leave India without the previous permission of the Court.
