HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR W.P.No.11240 of 2015 ORDER:

Heard the learned counsel for the petitioner and the learned Advocate General appearing for the 3rd respondent along with the learned Standing Counsel. The petitioner has questioned issuance of letter of intent to the 7th respondent on 10-04-2015 in pursuance of Tender Notification issued by the 3rd respondent on 26-03-2015. Various allegations are made by the petitioner including that the 7th respondent, who is declared as L1, appears to have known details of the tender and its conditions well in advance, as is evident from the demand drafts taken by him towards EMD, security deposit etc.

However, the learned Advocate General, on instructions, states that the contract agreement was entered into with the 7th respondent on 18-04-2015 and that the 7th respondent has commenced the work on 20-04-2015. In view of the subsequent development, the petitioner seeks to withdraw this writ petition with a liberty to question the contract agreement entered with the 7th respondent in accordance with law.

With the aforesaid liberty, the writ petition is dismissed as withdrawn. No order as to costs.
