This petition is filed seeking for grant of anticipatory bail to the petitioner, who is accused, in Crime No.846 of 2017 on the file of Kusaiguda Police Station, Rachakonda District.

The offences alleged are under Sections 417 and 376 IPC. 2.

Heard the counsel for the petitioner and the Public Prosecutor appearing for the respondent.

The counsel for the petitioner submits that the allegations levelled against the petitioner are false and that the complaint is filed with a delay.

A perusal of the complaint shows that there was marriage alliance between the de facto complainant and the petitioner and that when the petitioner went to the house of the de facto complainant, he expressed that his parents does not like her as she is not of fair complexion and saying that he would marry her by convincing his mother, he went away. Later, the petitioner took the de facto complainant to his house and sexually assaulted her and restrained her from going out and had sexual intercourse with her forcefully.

From the above allegations, prima facie, it appears that the petitioner has committed the alleged offences. The nature of the offences does not entitle the petitioner for an anticipatory bail.

With the above observations, the Criminal Petition is dismissed. However, the petitioner is at liberty to file a petition before the court below seeking for regular bail. As a sequel, the miscellaneous applications, if any pending, shall stand closed.
