HONOURABLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.8000 of 2017 ORDER:

Petitioner was declared as medically unfit for underground job in the respondent-company. When petitioner sought for provision of dependent employment as a consequence to the retirement on medical grounds, according to the petitioner, he was informed that he did not have 24 years of service and, therefore, not eligible to claim dependent employment. Contending that by the time he applied for consideration by the Corporate Medical Board, he had sufficient service, he sought for consideration of his request for provision of employment. It appears, said representation is pending consideration and so far no orders are passed.

When the matter is taken up for consideration, learned counsel for petitioner as well as learned standing counsel represented that writ petition can be disposed of with a direction to consider the representation of the petitioner.

Having regard to this submission, writ petition is disposed of, without expressing any opinion on merits, directing the General Manager (Personnel) (3rd respondent) to examine the representation submitted by the petitioner on 07.12.2016 with reference to the provision of dependent employment and pass appropriate orders as expeditiously as possible, preferably within a period of two months from the date of receipt of copy of this order.
