HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON Nos.7465 and 19676 of 2011 COMMON ORDER:
These writ petitions are filed questioning the proceedings dated 14-03-2011 cancelling the allotment of houses issued by the 3rd respondent in favour of the petitioners and proceedings dated 17-06-2011 issued after the petitioners submitted replies on 16-05-2011 by confirming the cancellation of the proceedings dated 14-03-2011.
Pending these writ petitions, on 10-08-2016 this Court directed the District Collector to depute an Officer not below the rank of Revenue Divisional Officer (R.D.O.) to inspect the subject houses, verify the actual, physical possession of each one of the houses said to have been allotted in favour of petitioners. Additional counter affidavit is filed and the enquiry reports are filed, in which it is stated that some petitioners are eligible and some petitioners are not eligible on various grounds. Learned counsel for the petitioners submits that the petitioners may be given opportunity to file objections in respect of the enquiry reports and also says that objections can be considered and necessary orders may be passed.
Learned Assistant Government Pleader for Revenue submits that enquiry was conducted and found that some of the petitioners are not eligible and some of the petitioners are eligible.
Since the report given by the R.D.O. is served on the counsel for the petitioners, without going into other aspects it is open for the petitioners, who are not found to be eligible as per report, to submit objections in respect of the same within a period of two weeks from today and on submission of objections, the R.D.O.
shall pass appropriate orders afresh within a period of four weeks, thereafter.
With the above direction, these writ petitions are disposed of. As a sequel to the disposal of these petitions, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 24-11-2016 Note:
