HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CIVIL REVISION PETITION No. 3181 of 2016 ORDER:

Assailing the order dated 28.03.2016 passed in I.A.No.304 of 2016 in O.S.No.469 of 2011 on the file of the Principal Junior Civil Judge, Tirupathi, the present Civil Revision Petition is filed under Article 227 of the constitution of India, wherein and whereunder an application filed to re-open the suit was dismissed.

A perusal of the material on record would show that the trial Court dismissed the recall petition only on the ground that the petition is silent as to the reason for recall of DW.1 and accordingly dismissed the present application to re-open the suit. In view of the above, the petitioner is directed to file a fresh application by giving reasons, in which event the trial Court shall consider the same in accordance with law.

With the above direction, the Civil Revision Petition is disposed of. There shall be no order as to costs. Miscellaneous Petitions, if any, pending in this Civil Revision Petition, shall stand closed.
