Heard the learned counsel for the petitioner and the learned Public Prosecutor.
2. The present Criminal Petition came to be filed by the petitioner/accused under Section 438 Cr.P.C., seeking release in the event of his arrest in Crime No.25 of 2016 of Hussainialam police station, Hyderabad district registered against him for the offences punishable under Sections 419 and 384 IPC.
3. By an order dated 03.08.2016 in Criminal Petition No.10557 of 2016, this Court rejected the request of the petitioner for grant of anticipatory bail in the aforesaid crime. In view of the above and in the absence of any change, either on facts or in law, after the date of dismissal of the last bail application, the question of entertaining second application for anticipatory bail does not arise. However, having regard to the circumstances, the petitioner shall surrender before the court concerned and file an application for grant of regular bail with prior notice to the Public Prosecutor concerned, in which event, the same shall be considered on the same day or at the earliest in accordance with law.
4. The Criminal Petition is dismissed with the above observation.
