THE HON'BLE SRI JUSTICE SURESH KUMAR KAIT AND THE HON'BLE SRI JUSTICE U.DURGA PRASAD RAO WRIT PETITION No.9148 OF 2017 JUDGMENT: (Oral) (Per the Hon'ble Sri Justice Suresh Kumar Kait) Vide the present petition, the petitioner seeks direction thereby directing the respondents No.1 and 2 to produce the petitioner's wife by name A. Ramya Goud, aged about 25 years, who is missing since 26.02.2017, before this Court.
2. As stated in the affidavit filed in support of the present petition that the petitioner got married with the above named girl on 20.07.2016 before the Sub Registrar Office, Achampet, Mahabubnagar District. Their marriage is a love marriage and they got married when their elders had refused to perform the said marriage. After knowing about the marriage, his father-in-law and mother-in-law i.e., respondents No.3 and 4 have detained his wife in their house and they are harassing his wife and refusing to sent to the petitioner to lead matrimonial life.
3. Pursuant to order dated 15.03.2017, the respondents No.3, 4 and A. Ramya Goud are present in the Court.
4. This Court has interacted with the above named girl and shown her marriage certificate, which is at page No.12 and photographs at Page Nos.15 and 16. We specifically
asked her whether this marriage has taken place. To which, she replied that the parents of the petitioner have asked her to sign on paper, accordingly, she signed. She further states that she doesn't want to stay with the petitioner and without any pressure and coercion, she is staying with her parents.
5. A Ramya Goud was born on 22.02.1992. She is 24 years old, B.Tech graduate and she is a major, who can think about her life. We cannot dictate terms to her whether she should live with the petitioner or with the parents or with someone else, which is her choice.
6. Keeping in view the facts recorded above, we do not feel to pass any direction in the present petition. However, parties are at liberty to take legal course available to them.
7. Accordingly, the Writ Petition is closed. There shall be no order as to costs.
Miscellaneous petitions, if any pending, shall stand closed.
