THE HON' BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.1464 of 2019 ORDER:

The writ petition is filed with the allegations that the respondent authorities are interfering with the construction activity of the petitioner which is being made in a small area of 39 square yards of land. Heard the learned counsel for the petitioner, and the learned Standing Counsel for respondents 2 and 3.

It is not in dispute that the petitioner, as on today, has not obtained permission to make construction. As a matter of fact, the permission sought by the petitioner came to be rejected by intimating the shortfall vide communication dated 18.01.2019.

In the circumstances, the writ petition is disposed of by leaving it open for the petitioner to fulfil the statutory requirements in accordance with law and re-apply for permission to carry on the construction activity. As it is clear that the petitioner does not have permission to make construction as on today, the petitioner shall not undertake any construction activity till he gets permission by satisfying the statutory requirements. However, the construction, if any already made, shall not be demolished by the respondent authorities. No costs. Miscellaneous petitions, if any pending, shall stand closed.
