THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.28682 of 2017 ORDER:

The case of the petitioners is that the first petitioner is doing petty kirana and rice business and the second petitioner is the owner of Bolero vehicle bearing No.TS 05 UA 7531. While so on 15.06.2017, the third respondent along Vigilance and Enforcement Officials intercepted the vehicle which was transporting rice. After inspection, total 287 bags of rice along with the vehicle were seized from house of the first petitioner alleging that the same was meant for PDS. The seized stock was handed over to M/s.Sri Satyanarayana Swamy Parboiled Rice Mill at Mattampally Village, Huzurnagar Road, Suryapet District, and the vehicle was handed over to the Station House Officer, Mattampally Police Station, for safe custody until further orders from the second respondent. The petitioners submitted a representation before the second respondent on 13.07.2017 for release of the entire seized stock and the vehicle pending 6A proceedings. When no orders were passed, the present Writ Petition is filed.

In the circumstances, this Writ Petition is disposed of directing the second respondent to release the vehicle and the seized stock, subject to the conditions imposed by him, within a period of one week from the date of receipt of a copy of this order by passing appropriate orders in that regard, as no useful purpose would be served by retaining them during the pendency

of 6A proceedings. However, such release would be subject to the final orders to be passed in the 6A proceedings. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs. ________________________________ (A.RAMALINGESWARA RAO, J) 28.08.2017 vs
