THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.676 of 2024 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C.

by petitioners/accused Nos.2 and seeking anticipatory bail in the event of their arrest in connection with F.I.R No.99 of 2023 on the file of the Maddirala Police Station, Suryapet District, registered for the offence punishable under Section 304-B of the Indian Penal Code (for short 'IPC').

Heard learned counsel for the petitioners, learned Additional Public Prosecutor for the respondent-State and perused the record.

The de facto complainant is brother of the deceased and brother-in-law of accused No.1. He filed a complaint stating that his elder sister was given in marriage to accused No.1 on 11.11.2016 and thereafter, she committed suicide on 15.06.2023. The reason given is that accused No.1 and these petitioners who are parents-in-law were harassing her,

for which, she consumed poison on 15.06.2023 and died on 16.06.2023 while undergoing treatment.

Learned counsel for the petitioners would submit that apart from bald allegation that these petitioners were demanding additional dowry, not a single incident is narrated in the complaint regarding involvement of these petitioners. Further, investigation is complete and accused No.1 was arrested and already released on bail. 5.

Keeping in view that bald allegation is leveled against these petitioners, the relief of anticipatory bail is granted to the petitioners, subject to the following conditions:

1) The petitioners/accused Nos.2 to 3 are directed to surrender before the Station House Officer, PS, Maddirala, Suryapet District, on or before 30.01.2024. Upon such surrender, the said Station House Officer shall release the petitioners/accused Nos.2 and 3 on bail, on their executing personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) each with two sureties for a like sum each to his satisfaction.

2) On such release, the petitioners/accused Nos.2 and 3 shall appear before the concerned Station

House Officer as and when required, for the purpose of investigation.

3) The petitioners/accused Nos.2 and 3 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case. 6.

Accordingly, the Criminal Petition is allowed.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
