THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL PETITION No.5104 of 2017 ORDER:

This petition is filed under Section 482 Cr.P.C. seeking to set aside the order dated 16.02.2017 in S.T.C.No.15 of 2011 passed by the learned II Additional District Munsif Magistrate, Tirupathi, Chittoor District.

Heard the learned counsel for the petitioner and the learned Public Prosecutor for the State of Andhra Pradesh. 3.

A perusal of the record reveals that the petitioner is facing trial in S.T.C.No.15 of 2011 on the file of the II Additional District Munsif Magistrate, Tirupathi, Chittoor District, for the offence punishable under Section 138 of Negotiable Instruments Act. A perusal of the record reveals that the trial Court issued NBW against the petitioner on 16.02.2017.

At the time of hearing, the only relief sought by the learned counsel for the petitioner is to direct the trial Court to dispose of the petition filed by the petitioner under Section 70 (2) Cr.P.C.

In view of the submission made by the learned counsel for the petitioner, the trial Court is hereby directed to dispose of the petition, if any, filed by the petitioner under Section 70(2) Cr.P.C. on the same day in accordance with law.

Accordingly, the Criminal Petition is disposed of. Consequently, Miscellaneous Petitions, if any, pending in this Criminal Petition shall stand closed.
