CVNR, J CRP 229/2018 ORDER:

This civil revision petition is filed questioning auction proceedings dt.9.1.2018 in E.P. No.105 of 2017 (old E.P. No.67 of 2014) in O.S. No.214 of 2011 on the file of the Principal Senior Civil Judge, Gajuwaka.

A perusal of the record shows that E.A. No.11 of 2018 filed by the petitioners for conducting auction by issuing a fresh paper publication was dismissed by the lower Court on 09.01.2018 and as a consequence of such dismissal, the lower Court has conducted the auction. The petitioners have not questioned the order in E.A. No.11 of 2018. In my opinion, as the auction was held following the dismissal of E.A. No.11 of 2018, the petitioners are not entitled to question such auction without questioning the order in E.A. No.11 of 2018. On this ground alone, the civil revision petition is dismissed. As a sequel to dismissal of the civil revision petition, interim order dt.11.1.2018 shall stand vacated and C.R.P. M.P.
