THE HON'BLE SRI JUSTICE T.VINOD KUMAR WRIT PETITION No.1372 OF 2020 ORDER:

The present Writ Petition is filed to declare the action of the respondents in not extending the parole period of the petitioner for a further period of two months, as being illegal, arbitrary and unconstitutional.

Heard Sri Dr. Challa Srinivasa Reddy, learned Counsel for the petitioner and learned Assistant Government Pleader for Home. Initially, when the Writ Petition was taken up for hearing, it was noticed that the petitioner did not make any representation to the authorities' concerned seeking extension of parole. However, thereafter the petitioner claims to have made a representation dated 23.01.2020 to the 1st respondent by sending the same by registered post.

Learned Assistant Government Pleader for Home, on written instructions dated 28.01.2020, would submit that the petitioner made a representation dated 23.01.2020 seeking extension of parole, though claimed to have been sent by registered post has not been received by the authorities till date. However, a copy of the said representation as furnished to the learned Government Pleader for Home at High Court, in turn, has been forwarded to the authorities concerned, who after considering the said representation and having regard to the parole Rules 1981 issued under G.O.Ms. No.647, Home (Prisons.C) Department dated 23.10.1981, wherein it is stated that the period of release on parole shall not ordinarily exceed one month and no further extension

shall be granted, the 1st respondent authority has rejected the request of the petitioner.

Having regard to the fact that the 1st respondent authority has considered the representation made by the petitioner as per the Rules governing for grant of parole as framed by G.O.Ms. No.647 dated 23.10.1981, no interference is called for with the order rejecting the request of the petitioner for extension of parole. Accordingly, the Writ Petition is dismissed. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed.
