HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.15012 OF 2017 ORDER:

The case of the petitioners is that the 5th respondent filed application before the 4th respondent for mutation of his name in revenue records and for issuance of pattadar pass book and title deeds in respect of the lands admeasuring Ac.1.64 cents in Survey No.476/2 of Avilala Village for which the petitioners filed objections. The apprehension of the petitioners is that the 4th respondent without considering their objections is going to dispose of the application of the 5th respondent. As such, the petitioners filed the present writ petition.

Learned counsel for the petitioners submits that the husband of the 5th respondent's vendor sold the subject lands to the vendor of the petitioners, as such petitioners have right in the subject lands and that without considering the petitioners' objections, mutation cannot be granted in favour of 5th respondent.

Heard learned Assistant Government Pleader for Revenue.

As on today, no order is passed by the 4th respondent mutating the subject lands in favour of 5th respondent. Since it is stated that petitioners have already filed objections, the

4th respondent is directed to consider the said objections filed by the petitioners, as per law, before disposing of the application of the 5th respondent, after issuing notice to the petitioners.

With the above direction, the writ petition is disposed of. No order as to costs.
