THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI APPEAL SUIT No.1298 of 1999 JUDGMENT:

Earlier, as there was no representation for the appellant on 18.12.2017, this Court directed the matter to be listed under the caption "for dismissal". Subsequently, there was no representation for the appellant on 24.01.2018 and, therefore, on 24.01.2018, this Court directed to post the matter on 31.01.2018 under the same caption. On that day, a request was made for adjourning the matter and, accordingly, this Court directed to list the matter on 20.02.2018 under the same caption. Again, at request, the matter was directed to be posted today under the same caption. Yet again, there is no representation for the appellant. The above conduct of the appellant indicates that the appellant is not interested in prosecuting the Appeal Suit.

In the result, the Appeal Suit is dismissed for default. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order.

There shall be no order as to costs.
