THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM CIVIL REVISION PETITION No.246 OF 2018 ORDER:

This civil revision petition is filed challenging the notice dated 13.09.2017 in E.P.No.183 of 2017 in DRA No.82 of 2016 on the file of the Principal Senior Civil Judge, Anantapur. The said E.P. is filed for implementation of the order dated 21.02.2017 in DRA No.82 of 2016.

Learned counsel for the petitioners submits that pursuant to the order of this Court, dated 25.01.2018, the petitioners have deposited 1/4th of the decretal amount. He also submits that against the order dated 21.02.2017 an appeal lies to the State Government.

Hence, without expressing any opinion on the merits of the matter, the Civil Revision Petition is disposed of leaving it open to the petitioners to avail the remedy of appeal. While considering the aspect of limitation, the Government may take into consideration of the fact of pendency of CRP and extend the benefit of Section 14 of the Limitation Act while entertaining the appeal. Pending Miscellaneous petitions, if any, pending shall stand closed. No costs.
