THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No.35844 OF 2015 ORDER:

Heard.

The petitioner questions the action of respondents 2 and 3 in insisting No Objection Certificate from respondents 4 to 6 with regard to Plot No.5, D.No.506/2, Guntur Municipal Corporation Area, Guntur District.

The issue relating to Plot Nos.3 and 4 in D.No.506/2 was considered by this Court in W.P.No.33598 of 2014, dated 10.11.2014. Regarding the same issue, this Court has already disposed of similar batch of writ petitions in W.P.No.21182 of 2015 and Batch, dated 10.07.2015.

Following the said judgment, this Writ Petition is also disposed of directing the registering authorities concerned to receive and process the documents presented by the petitioner without insisting upon the No Objection Certificate to be obtained by him. The registering authorities concerned are further directed to receive and process the same in accordance with the Registration Act, 1908 and the Indian Stamp Act, 1899 and if the document is in conformity with the provisions, thereafter register and release the documents in accordance with the due procedure. It is also made clear that in the event of registering authority not being satisfied with the compliance under the Registration Act or the Stamp Act, appropriate refusal endorsement together with reasons shall be recorded and communicated to the parties in terms of Section 71 of the Registration Act. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
