O R D E R

This civil revision petition under Article 227 of the Constitution is preferred by the plaintiff in O.S.No.1417 of 2016 on the file of the learned III Additional District Judge, Ranga Reddy District at L.B.Nagar. As this Court does not propose to venture into the merits of the matter and the grievance of the petitioner/plaintiff is only with regard to non-disposal of I.A.No.964 of 2016 filed by her in her eviction suit, O.S.No.1417 of 2016, this Court sees no necessity to put the respondents on notice or afford them an opportunity of hearing. The petitioner/plaintiff filed the suit for eviction of the respondents/tenants; for arrears of rent and for mesne profits. Therein, she filed I.A.No.964 of 2016 under Order 15-A CPC. Perusal of the Docket Order reflects that the subject I.A. is being adjourned from time to time.

When Order 15-A CPC has been inserted in the statute book so as to come to the rescue of the landlord who is the plaintiff in the suit for eviction, the trial Court must necessarily give priority to the application filed under this provision. The same should not be kept pending to the detriment of the landlord-plaintiff.

The civil revision petition is accordingly disposed of directing the trial Court to adjudicate upon I.A.No.964 of 2016 expeditiously after hearing both parties and preferably within two months from the date of receipt of a copy of this order.

Pending miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs.
