HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.44708 OF 2016 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed by the petitioners seeking to declare the inaction of the 2nd respondent in disposing of the un-numbered IA filed on 23.03.2015 in Appeal No.P1/892/2009, as illegal and arbitrary. Heard the learned counsel for the petitioners and the learned Assistant Government Pleader for Revenue for respondents. With their consent, the Writ Petition is disposed of at the stage of admission itself. There is no necessity to put respondent Nos.6 to 9 on notice since this Court is not venturing to adjudicate the case on merits.

The limited grievance of the petitioners in this writ petition is that though they filed an interlocutory application on 23.03.2015 before the 2nd respondent seeking to implead them as respondents 8 and 9 in Appeal No.P1/892/2009, till date no orders are passed. Learned AGP would submit that since the I.A. was filed in the year 2015, a suitable direction may be given to the 2nd respondent for disposal of interlocutory application submitted by the petitioners on 23.03.2015, in accordance with law. Having regard to the rival submissions made, the Writ Petition is disposed of directing the 2nd respondent-The Chief Commissioner of Land Administration, Hyderabad, to take up the un-numbered interlocutory application, if it is in order, filed by the petitioners on 23.03.2015 seeking to implead them as

respondents 8 and 9 in Appeal No.P1/892/2009, and pass appropriate orders therein, after hearing the petitioners and unofficial respondents herein, in accordance with law, as early as possible, preferably within a period of six weeks from the date of receipt of a copy of this order.
