THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY W.P.NO.1396 OF 2020

O R D E R

The case of the petitioner is that the 3rd respondent - Revenue Divisional Officer, vide order in Appeal Case No.D/ 1166/ 2019 dated 19.12.2019, set aside the transfer of the subject land made in favour of her husband. Aggrieved by the same, she preferred revision under Section 9 of the Telangana Rights in Land Pattedar Pass Books Act, 1971 on the file of 2nd respondent - Joint Collector, in Revision Petition No.223/ 13/ 2020, against unofficial respondent No.5 herein and others. In the revision, petitioner filed interlocutory application seeking stay of the order passed by the 3rd respondent. The grievance of the petitioner in this writ petition is that, the 2nd respondent is neither passing any order in the stay petition, nor disposing of the revision.

This court, on 28.01.2020, passed interim order, for a limited period, directing the parties to maintain status quo with regard to entries in the revenue records in respect of the subject property. Heard the learned counsel for the petitioner and the learned Assistant Government for Revenue.

Though notice is served on unofficial respondent No.5, there is no representation and no counter affidavit is filed. Having regard to the facts and circumstances of the case and the submissions of the learned counsel, writ petition is disposed of directing the 2nd respondent to dispose of the revision petition filed by petitioner, which is referred to above, in accordance with law, after issuing notice to the unofficial respondent No.5 and other affected parties, if any, and

affording opportunity of hearing to all the parties, within a period of three months from the date of receipt of a copy of this order. Till the disposal of the revision, the interim order granted by this court on 28.01.2020 shall continue.

Interlocutory applications pending, if any, shall stand closed. No order as to costs.
