The case of the petitioner is that he is the owner and possessor to an extent of the land in Sy.No.40/1A1A1A in plot No.210 C an extent of 814 Square Feet situated at Vidyadhara Puram, Vijayawada municipal corporation, Krishna District and an extent of 59 square yards situated at Door No.3-1-194 in Assessment No.574 D, 574 E, 574 Vidhyadhara Puram, Vijayawada municipal corporation, Krishna District and he is in possession and enjoyment of the said property. It is stated that the petitioner acquired the said property by way of Will executed by his father and mother and also by way of patta. But the R&B authorities without following due process of law, trying to evict the petitioner. Aggrieved by the same, the present writ petition is filed. This Court granted interim orders on 01-07-2016. Today, the learned Assistant Government Pleader for Roads and Buildings on instructions submits that they will follow due process of law before evicting the petitioner.
Recording the same, the writ petition is disposed of directing the respondents not to evict the petitioner without following due process of law. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
