THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CIVIL REVISION PETITION Nos.1710 & 4201 OF 2016 COMMON ORDER:
These Civil Revision Petitions, under Article 227 of the Constitution of India, are filed challenging the orders dated 15.02.2016 and 28.03.2016 passed in I.A. No.11 of 2016 & I.A. No.42 of 2016 in O.S. No.45 of 2015 by the Junior Civil Judge, Nandaluru, whereby the learned Junior Civil Judge allowed the petitions filed under Rule 9 of Order XXVI of the Code of Civil Procedure, 1908 (for short 'CPC') appointing an AdvocateCommissioner. In CRP No.1710 of 2016 this court issued a direction on 04.04.2016 to the Commissioner to execute the warrant and submit the report in a sealed cover before the trial court, without entitlement to obtain copies by both parties, pending the revision. After arguing the matter for a while, both the counsel requested this court to direct the trial court to decide the suit itself within a specified time.
Acceding to the request made by both the counsel, since the suit is of the year 2015, I deem it appropriate to direct the trial court to decide the suit as expeditiously as possible, without deciding merits, in any event not later than six months, in accordance with law.
MSM,J CRP_1710 & 4201_2016 - 2 - It is left open to the trial court to open the commissioner report which was kept in a sealed cover and consider the same, at appropriate stage.
With the above direction, these civil revision petitions are disposed of.
