...RESPONDENT/COMPLAINANT Petition under Section 438 of Cr.P.C praying that in the circumstances stated in the Memorandum of Grounds of Criminal Petition, the High Court may be pleased to enlarge the Petitioner/Accused no.2 on bail in the event of his arrest in Crime No. 46 ot 2020 of EXCISE SERILINGAIMPALLY on such condition or conditions as this Hon'ble High Court may deem fit and proper in the interest of Justice. This Petition coming on for hearing, upon perusing the Memorandum of Grounds of Criminal Petition and upon hearing the arguments of Sri tt4.AMARNATH, Advocate for the Petitioner and the Public Prosecutor (TG) on behalf of the Respondent.

HONOURABLE JUSTICE G. SRI DEVI CRIMINAL ON NO .s12 0F 202l /, ORDER:

This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973 (Cr.P.C.), is filed by the petitioner/A-2, for grant of anticipatory bail in Crime No'46 of 2O2O of Excise Serlingampally, registered for the offence punishable under Section 8 (c) r/w 20 (b) (ii) of the NDPS Act' Heard the learned counsel for the petitioner lA-2, the learned Additional Public Prosecutor representing the respondent-State and perused the record.

In the FIR, it is inter alia stated that on 27 '12.2020 at about 3.20 pm, Shamshabad Team raided H.No. 1-24, Nanakramguda, Serilingampally Mandal, Ranga Reddy District, and seized 4'070 kgs of dry ganja ald arrested A- 1 . A- 1.. confessed the involvement of the petitionerlA-2 and A-3 in the said offence. Hence, the FIR' karned counsel for the petitioner/A-2 would submit that the petitioner is innocent of the offence and he is no way concerned with the alleged offence. The petitioner/A-2 is a lawabiding citizen and is prepared to abide by any condition which this Court may deem fit to impose in case of granting anticipatory bail. Hence, he prayed to grant anticipatory bail to the petitioner/A-2.

Learned Additional Public Prosecutor representing the respondent-State opposed to grant anticipatory bail to the petitioner/A-2.

As seen from the contents of the FIR, there are specific allegations against the petitioner/A-2 since A- 1 mentioned the name of the petitioner/ A-2.

Having regard to the facts and circumstances of the case, nature and gravity of the offence, this Court is not inclined to grant anticipatory bail to the petitioner/A-2.

The Criminal Petition is, accordingly, dismissed. However, if the petitioner/A-2 surrenders before the competent Court within a period of fifteen days from today and applies for regular bai1, the same shall be considered by the said Court, in accordance with 1aw.

Miscellaneous applications, if any, pending shall stand closed.
