ORDER:

This Criminal Petition is filed under Sec.482 Cr.P.C. against the order in Crl.M.P. No.92 of 2015 in Criminal Appeal No.522 of 2015 dated 01.07.2015 passed by the learned XIII Additional District and Sessions Judge, Ranga Reddy District, L.B.Nagar, Hyderabad, by and under which the learned Additional District and Sessions Judge suspended the operation of sentence of imprisonment imposed on the petitioner by the learned IV Special Magistrate, Kukatpally at Miyapur, subject to the condition that the petitioner shall deposit Rs.90,000/- in the lower Court within 45 days from the date of the order. The learned counsel appearing for the petitioner submits that the petitioner is a poor person and he is not in a position to pay Rs.90,000/- as ordered above.

He further submits that the petitioner is only the surety, but not principal beneficiary to the transaction. In the circumstances of the case, it is felt that the impugned order be modified to the effect that the petitioner shall deposit Rs.50,000/- (Rupees fifty thousand only) to the credit of the trial Court within two weeks from today.

With the above directions, the Criminal Petition is disposed of. Miscellaneous Petitions, pending if any in this Criminal Petition, shall stand closed.
