THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.21426 of 2005 ORDER:

This writ petition was filed by the Hyderabad Metropolitan Water Supply and Sewerage Board aggrieved by the order dated 01.10.2004 passed by the Labour Court-I, Hyderabad, in M.P.No.8 of 2002. The said order was passed at the behest of the 2nd respondent herein, who was the petitioner before the Labour Court. However, the writ petition was dismissed for default against the 2nd respondent as per the Court order dated 30.12.2010, which was given effect to on 11.03.2011. The validity of the order passed by the Labour Court cannot be examined in the absence of the 2nd respondent at whose behest it was passed. The writ petition must therefore fail in its entirety and it is accordingly dismissed.

Interim order dated 03.10.2005 shall stand vacated. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
