HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND THE HON'BLE SRI JUSTICE S.V. BHATT WRIT PETITION No. 13842 of 2015 PC: (per the Hon'ble the Acting Chief Justice Dilip B. Bhosale) Heard learned counsel for the parties.
Mr.P. Kesava Rao, learned Standing Counsel for the Greater Hyderabad Municipal Corporation, on instructions from Mr.E.D.Vijaya Raju, Deputy Commissioner, who is present in the Court, submits that the Corporation shall withdraw notice, dated 14.03.2014 (Annexure 'P8' collectively), and the communication, dated 14.03.2014 (Annexure 'P9'), with liberty to the Corporation to issue fresh notice seeking revision of the property tax and to issue demand notice, as per the provisions of the Greater Hyderabad Municipal Corporation Act, 1955. Writ petition is disposed of, in view of the submission made by learned Standing Counsel for the Corporation. The notice, dated 14.03.2014 (Annexure 'P8'), and communication, dated 14.03.2014 (Annexure 'P9'), are allowed to be withdrawn with liberty as prayed. All contentions of the parties on merits are kept open. It is made clear that if any tax in pursuance of the notice, dated 14.03.2014, and communication, dated 14.03.2014, is recovered, same shall be adjusted towards the demand that will be made by the Corporation in future.
Consequently, miscellaneous petitions, if any, also stand disposed of.
