THE HONOURABLE SRI JUSTICE K. LAKSHMAN CRIMINAL PETITION No. 471 OF 2021 ORDER:

This Criminal Petition under Section 482 of the Code of Criminal Procedure, 1973 (for shot 'Cr.P.C.'), is filed seeking to quash the proceedings in Crime.No.2 of 2021 pending on the file of the Station House Officer, Khanapur Police Station, Warangal District. The petitioner herein is accused in the said crime. The offences alleged against the petitioner are under Sections 353 and 323 of the Indian Penal Code.

2. Heard the learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondents. Perused the record.

Sri V.Yadu Krishna Sainath, learned counsel for the petitioner would submit that though he has filed the present petition raising several contentions and grounds, he is restricting his relief only to a direction to the Investigating Officer to follow the procedure laid down under Section 41-A Cr.P.C. and guidelines issued by the Hon'ble Supreme Court in Arnesh Kumar v. State of Bihar1.

In view of the said submission, this Criminal Petition is disposed of directing the Investigating Officer in Crime.No.2 of 2021 pending on the file of the Station House Officer, Khanapur Police Station, Warangal District, to strictly follow the 1 (2014) 8 SCC 273

mandatory procedure contemplated under Section 41-A of Cr.P.C. and also the guidelines issued by the Hon'ble Supreme Court in Arnesh Kumar's case (supra).

Miscellaneous Petitions, pending if any, shall stand closed.
