CRIMINAL PETITION NO. 388 OF 2018 O R D E R :
This Criminal Petition is filed by the petitioners under section 438 of Cr.P.C., seeking grant of bail to the petitioners, who are A-1 to A-3 in Crime No. 84 of 2017 of Guntakal II-TownPolice Station, Ananthapur district, registered for the offences punishable under section 498-A read with section 34 of I.P.C. and section 3 and 4 of Dowry Prohibition Act.
2. Heard the counsel for the petitioners and the learned Additional Public Prosecutor representing the respondent/State.
3. A perusal of the complaint shows that there are specific allegations against all these petitioners, that they harassed the defactocomplainant mentally and physically, to get additional dowry from her parents and more particularly there is specific allegation against A-3, who is father-in-law of the defacto-complainant that he abused and that when she informed the matter to A-1 and A-2, they too abused her.
4. In view of the above nature of allegations, this Court opines that it is not a fit case to enlarge the petitioners on anticipatory bail. However, the Station House Officer, Guntakal II-Town Police Station, Ananthapur district, is directed to follow the guidelines laid down by the Hon'ble Supreme Court in ARNESH KUMAR V/s. STATE OF BIHAR AND ANR., vide judgment dated 02/7/2014 passed in Criminal Appeal No. 12777 of 2014 { Special Leave Petition [CRL.] No. 9127 of 2013 }, before arresting the petitioner.
5. Hence, in view of the above, this Criminal Petition is dismissed. Guntakal II-Town Police Station, Ananthapur district, is directed
6. As a sequel, miscellaneous petitions if any, pending in this Criminal Petition shall stand closed.
