This Criminal Petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') for grant of pre-arrest bail to the petitioners, who are arrayed as accused in Crime No.1082 of 2024 of Dundigal Police Station, Cyberabad Commissionerate, registered for the offences punishable under Sections 467, 468, 419, 420 r/w 34 of the IPC.

The case of the prosecution is that, on 21-12-2024, the de-facto complainant lodged a report before the police stating that he is the son of one Parsha Ramaiah and his father is having land of Ac.0.06 gts in sy.no.300/A at Bowrampet village and his father's and grandfather's names were recorded as pattedars in the pahanies from 1960 to 2014. Smt. Alilamma has shown the name of the father of the complainant as her husband and after that they have colluded with revenue officials in the year 2013 and have submitted application for pattedar passbook and mutated the land in her name and forged the document and thereafter, she sold away the said property to the petitioners herein. Hence, he requested for necessary action. Basing on the said complainant, the police registered a case for the above said offences.

Heard Sri S. Ravindar Reddy, learned counsel appearing on behalf of the petitioners as well as Sri M. Vivekananda Reddy, learned Assistant Public Prosecutor for respondentState. 4.
Learned counsel for the petitioners submitted that the petitioners herein are innocent of the said allegations and in
fact, petitioner No.1 is the wife of one Parsha Ramaiah and he was died and thereafter, she filed an application before the concerned authority for mutation of the land in her name and the father of the de-facto complainant and husband of the petitioner No.1 are not one and the same and only to grab the land, a false case is registered against the petitioners herein and the investigation is based on the documentary evidence and the custodial interrogation of the petitioners is not required. Therefore, he prayed the Court to grant pre-arrest bail to the petitioners by allowing this criminal petition. 5.
On the other hand, learned Assistant Public Prosecutor opposed the submissions made by learned counsel for petitioners stating that the allegations against the petitioners herein are serious in nature. Further, he stated that the investigation is at the initial stage and the custodial interrogation of the petitioners is required for further investigation. Therefore, he prayed the Court to dismiss the Criminal Petition.

In the light of the submissions made by both the learned counsel and on a perusal of the material available on record, the petitioners herein are accused Nos.1 to 6 and the
record shows that, in the year 2013, the land was mutated in the name of the petitioners herein and the complaint is filed in the month of December, 2024 and according to the learned Assistant Public Prosecutor, only documentary evidence is required for further investigation. Considering the facts and circumstances of the case and also that the investigation is only on the documentary evidence, this Court deems it fit to grant pre-arrest bail to the petitioners, subject to the following conditions:
i.
The petitioners shall surrender before the Station House Officer, Dundigal Police Station, Cyberabad Commissionerate, within two weeks from today, and on such surrender, the said Station House Officer shall release them on bail on executing a personal bond for Rs.25,000/- each, with two sureties, for the like sum each.
ii.
The petitioners shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha
Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case.
iii.
The petitioners shall appear before the concerned Investigating Officer on every Monday between 09:00 a.m, and 05:00 p.m., for a period of 8 weeks or till the filing of the charge sheet, whichever is earlier, and thereafter, as and when required.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
