Upparapu Mondaiah v. The State Of Telangana
THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY W.P.NO.1402 OF 2020
O R D E R
Aggrieved by the inaction of the 3rd respondent - Tahsildar, in mutating the names of the petitioners in the revenue records in pursuance of their application dated 30.08.2019, filed under Form VI (A) prescribed under Section 4 of the Telangana Rights in Land and Pattadar Pass books Act, 1971 (for short 'the Act'), the present writ petition is filed. Heard the learned counsel for the petitioners. Learned Assistant Government Pleader for Home, on instructions, submits that application under Form VI(A) as prescribed under Section 4 of the Act read with Rule 18 of the Telangana Rights in Land and Pattadar Pass Books Rules, 1989, can be considered only in respect of the registered sale deeds, but in the present case, the petitioners, relying on simple unregistered sale deed (sada sale deed), are seeking for mutation of their names in the revenue records, and hence the same cannot be considered.
Learned counsel appearing for the petitioners could not dispute the above submission of the learned Assistant Government Pleader for Revenue. In view of the same, the relief sought for by the petitioners cannot be considered, and the writ petition is disposed of leaving it open to the petitioners to avail alternative remedies available under law. Interlocutory applications pending, if any, shall stand closed. No order as to costs.
