THE HON'BLE SRI JUSTICE SURESH KUMAR KAIT AND THE HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CMA No.1938 of 2004 JUDGMENT: (Oral) (Per Hon'ble Sri Justice Suresh Kumar Kait) The appellant and respondent have filed the joint memo whereby they intend to live together for their mutual benefits and for the welfare of their daughter and to perform her marriage. 2) The appellant/husband filed O.P.No.36/1999 under Section 13(1)(1A) of Hindu Marriage Act for grant of decree of divorce and the same was dismissed vide order dated 15.09.2003. Being aggrieved, the appellant filed the instant appeal. During pendency of the appeal, the appellant and respondent have entered into compromise to stay together. Therefore, they filed the joint memo.
3) The appellant and respondent both are personally present in Court with their respective counsel and identified by them. In addition to above, the appellant has produced the Aadhaar Card issued by the Government of India vide No.933130433144. The Photostat copy of the same kept on record. Original seen and returned to the appellant. Respondent/wife is also present in Court and she does not dispute to the joint memo filed by her. 3) Accordingly, the present appeal is disposed of as settled. No costs.
As a sequel, Miscellaneous Petitions, if any pending, shall stand closed.
