THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION No.1361 of 2015 ORDER:

The petitioner, who is A2, filed the present application under Sections 437 and 439 of the Code of the Criminal Procedure (Cr.P.C.), seeking enlargement on bail in Crime No.122 of 2014 of Kulcharam Police Station, Medak District, registered for the offences punishable under Sections 302, 201 and Section 109 read with Section 34 of IPC. Learned counsel for the petitioner submits that though the petitioner is alleged to have been arrested on 04.12.2014, till date no charge sheet has been filed.

Learned Public Prosecutor submits that the instructions received by him on 25.02.2015 does not anywhere disclose filing of charge sheet. But since the period of 90 days expires in the first week of March, 2015, it would be appropriate if the petitioner makes an application seeking default/statutory bail before the concerned Court. Learned counsel for the petitioner also seeks permission to make an application before the concerned Court.

Having regard to the circumstances stated above, the criminal petition is disposed of by directing the petitioner to make an application seeking default bail under Section 167 (2) of Cr.P.C. before the concerned Court, in which event, the same shall be considered in accordance with law.

As a sequel thereto, Miscellaneous Petitions, if any, pending shall stand closed.
