HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.3769 OF 2016 ORDER:

The writ petition is filed on the apprehension that the respondents 3 to 4 are trying to demolish the houses bearing Door Nos.5/42-5 of the 1st petitioner and 5/42/4 of the 2nd petitioner, 5-3A of the 3rd petitioner and 5/35 of the 4th petitioner situated at Kakkalapalli Village, Anantapur Rural Mandal, Anantapur District without issuing any notices or without following due process of law.

Heard the learned counsel for the petitioner and the learned Government Pleader for Panchayat Raj.

Subsequently to filing of the present writ petition, the petitioner also filed another Writ Petition No.12107 of 2016 questioning the notice dated 1.4.2016 issued by the 4th respondent-Gram Panchayat and this Court disposed of the same by an order dated 12.04.2016 leaving it open to the petitioner to file objections to the show cause notice dated 1.4.2016 to enable the 4th respondent-Gram Pancyat to conduct enquiry and to pass appropriate orders. This Court in the said W.P.No.12107 of 2016 also directed till such time the explanation submitted by the petitioner is considered and orders are passed, no coercive action shall be taken.

In the light of the order dated 12.04.2016 passed by this Court in W.P.No.12107 of 2016 and the present writ petition is filed only on an apprehension, the same does not survive. Further, after filing of the Writ Petition No.3769 of 2016 a notice dated 01.04.2016 came to be issued and orders having been passed.

Accordingly, the writ petition is closed. No order as to costs. Miscellaneous Petitions pending, if any, in this writ petition shall stand dismissed.
