CRIMINAL PETITION NO. 390 OF 2018 O R D E R :

This Criminal Petition is filed by the petitioner under section 438 of Cr.P.C., seeking grant of bail to the petitioner, who is accused in Crime No. 63 of 2017 of Varadaiahpalem Police Station, Chittoor district, registered for the offences punishable under section 376 read with section 511 of I.P.C.

2. Heard the counsel for the petitioner and the learned Additional Public Prosecutor representing the respondent/State.

3. A perusal of the complaint shows that there are serious allegations against the petitioner. The allegation is that he tried to commit rape on the defacto-complainant.

4. Hence, in view of the above, this Court opines that it is not a fit case for grant of anticipatory bail to the petitioner. The petitioner can surrender before the concerned court and seek regular bail. On such surrender, the concerned court is directed to consider the bail

application of the petitioner on merits and in accordance with law on the same day, subject to pressure of work.

5. With the above observation, this Criminal Petition is dismissed.

6. As a sequel, miscellaneous petitions if any, pending in this Criminal Petition shall stand closed.
