PNR,J CC .No.1728 of 2017 HONOURABLE SRI JUSTICE P.NAVEEN RAO CONTEMPT CASE NO.1728 of 2017 ORDER:

This contempt case is filed alleging that in violation of directions of the Court dated 07.07.2014 made in W.P.M.P.No.19215 of 2014 in W.P.No.15509 of 2014, constructions were made and, therefore petitioner in the writ petitioner violated the directions of the Court and such violation is willful and deliberate. 2.

In paragraph-3 of the counter-affidavit, respondent, who is petitioner in the writ petition, stated that shed was already constructed and was leased out to Nagarjuna Steel Traders on monthly rent. The temple is being constructed in the private land and no other construction is made after the interim order was granted by the Court. Along with the counter-affidavit, photographs are also enclosed to show that temple is being constructed in private land and no additions are made to existing shed.

Based on the instructions furnished in the form of draft counter-affidavit, learned Assistant Government Pleader states that no further construction was made to the shed already constructed after the interim order was passed.

Having regard to these submissions, it cannot be said that petitioner in the writ petition, who is 1st respondent herein, has violated the directions of the Court, warranting initiation of proceedings under the Contempt of Courts Act and Contempt Case is accordingly closed.
