HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 14969 of 2002 ORDER:

This writ petition is filed seeking to issue a writ of mandamus declaring the action of the respondents in not giving the benefit of seniority from the date of appointment i.e., 13.01.1992 as per the judgment of this Court dated 09.03.1995 passed in W.P.No.14469 of 1994, as illegal and arbitrary. A consequential direction is also sought to the respondents to give the benefit of seniority to the petitioner with effect from 13.01.1992 and promote him as Lineman. Heard Sri S. Satyam Reddy, learned counsel for the petitioner, and learned standing counsel for the respondents. It has been contended by the petitioner that he was initially appointed as Helper in the respondent corporation on 13.01.1992. Thereafter, he was terminated from service vide orders dated 21.09.1993 without assigning any reasons. Challenging the same, he filed W.P.No.

14469 of 1994 and this Court allowed the said writ petition vide orders dated 09.03.1995 directing the respondents to reinstate him into service. It has also been contended by the petitioner that in the seniority list circulated by the respondents on 31.10.1999, his name is placed at serial number 21 and it is noted that his services were not regularized. The grievance of the petitioner is that he is entitled for all the service benefits from the date of his initial appointment.

This Court, having considered the submissions made by the parties and perused the record, is of the considered view that the writ petition can be disposed of with a direction to the petitioner to submit a representation to the respondents seeking all the service benefits from the date of his initial appointment.

Accordingly, the writ petition is disposed of directing the petitioner to submit a representation to the respondents seeking all the service benefits from the date of his initial appointment within two weeks from the date of receipt of a copy of this order, and upon receiving such representation, the respondents shall consider the same and pass appropriate orders in four weeks thereafter.
