THE HON'BLE SRI JUSTICE T.VINOD KUMAR WRIT PETITION No.1397 OF 2020 ORDER:

The present Writ Petition is filed questioning the inaction of the official respondents in not taking necessary action against respondent Nos.6 and 7 based on the complaints dated 03.06.2019, 24.12.2019 and complaint made by the petitioner's daughter dated 02.01.2020, as being illegal and arbitrary. Heard Sri Kadaru Prabhakar Rao, learned Counsel for the petitioner and learned Assistant Government Pleader for Home. Learned Assistant Government Pleader for Home, on written instructions dated 27.01.2020, submits that based on the complaint made by the petitioner on 03.06.2019, a G.D. entry and during enquiry, it disclosed that the matter is civil in nature, as such closed the petition given by the petitioner. Further, again on 24.12.

2019, the petitioner gave another complaint to the Station House Officer, Karakagudem, wherein he alleges that his father's house was allotted to his daughters as per the court orders, upon which his brothers bore grudge and abused the petitioner in filthy language and tried to evict them from the house and made conspiracy to do away with his father. It is submitted that on receipt of the above petition, G.D. entry was made and enquiry was being done, the petitioner gave same complaint again on 02.01.2020 on the same facts, and that after enquiry, a case was registered in Crime No.2 of 2020 under Section 294(b) and 506 IPC of Karakagudem police station on 02.01.2020.

Since, the respondent authorities have now registered a case in Crime No.2 of 2020, based on the complaint of the petitioner dated 24.12.2019, and is under investigation, the grievance of the petitioner in the present Writ Petition stands redressed and no further orders need be passed in the matter.

Accordingly, the Writ Petition is closed. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed.
