This Court made the following:
ORDER:
This is an application for appointment of an Arbitrator under Section 11 of the Arbitration and Conciliation Act, 1996.
Though on the last occasion i.e., on 13.02.2015, a learned lawyer appeared for the respondent and took time to file counter-affidavit, today no one appears for
the respondent.
The parties have agreed in writing to resolve the disputes that arise between them by arbitration mechanism. Clause 12 of the agreement reads as under: "In case of any dispute/disputes among the partners such dispute/disputes shall be referred to an arbitrator/arbitrators and the decision of the arbitrators shall be final and binding on all the partners."
I am satisfied that the disputes raised by the applicants herein are covered by the aforesaid arbitration clause.
Accordingly, I appoint Sri Narayan Chawala, Retired District Judge, sole arbitrator to adjudicate the disputes between the parties to be placed before him. The learned Arbitrator will fix his own remuneration upon deliberation and consultation with the parties. He will also fix the costs and expenses of the secretarial assistance for the arbitration proceedings upon deliberation and consultation with the parties. All the costs and expenses of the arbitration proceedings shall be borne by both the parties in equal share. The learned Arbitrator is directed to conclude the arbitration proceedings and make publication of Award within five months from the date of entering upon the reference.
