HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.38550 of 2016 ORDER:
This writ petition is filed seeking to declare the action of the respondents 3 to 6 in insisting the petitioner to vacate from his agricultural land at the instance of the 7th respondent and consequently direct the respondents not to interfere with the possession and enjoyment of the petitioner over the said land. Heard and perused the material available on record. The case of the petitioner is that he is the absolute owner and possessor of land in different survey numbers situated at Kamaravarapukota village and Mandal, West Godavari District, and in the year 2008 the 7th respondent started interfering with his peaceful possession and enjoyment over the said property and filed civil suits, but he was not succeeded in the said suits. Therefore, he is influencing the official respondents to dispossess the petitioner from the subject land.
Considering the circumstances of the case, without expressing any opinion on merits, the Writ Petition is disposed of directing the official respondents not to interfere with the civil disputes pending between the petitioner and the 7th respondent and also not to dispossess the petitioner from the subject land, except under due process of law. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. ______________ RAJA ELANGO, J November 09, 2016.
