U.Sampath v. State Of Telangana
SMT JUSTICE T.RAJANI CRIMINAL PETITON No.412 OF 2018 ORDER:
This petition is filed seeking for grant of anticipatory bail to the petitioner, who is sole accused, in Crime No.207 of 2017 on the file of Chennaraopet Police Station, Warangal District. The offences alleged are under Sections 354, 509, 506 IPC, Section 7 r/w 8, 11(i) r/w 12 POCSO Act, 2012. 2.
Heard the counsel for the petitioner and the Public Prosecutor appearing for the respondent.
3.
A perusal of the complaint would show that this petitioner is a teacher in the school of the daughter of the defacto complainant and that he misbehaved with the girl. The delay in lodging the complaint would also not help the petitioner in obtaining anticipatory bail, as, in such cases, the victims would not be in a position to disclose the facts immediately.
4. Hence, in view of the above allegations, this court opines that this is not a fit case for granting anticipatory bail. 5.
Accordingly, the Criminal Petition is dismissed.
However, the petitioner can file a petition seeking for regular bail by surrendering himself before the court below. The court below shall dispose of the bail application, if any filed,
expeditiously, preferably on the same day, subject to the pressure of other work.
As a sequel, miscellaneous petitions pending consideration, if any, in this case shall stand closed. _____________ T.RAJANI, J 25.01.2018 SS
