Qundupalli Sateesh , Sathish Kumar v. State Of A.P,
THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION NO.2700 of 2016
ORDER
This petition u/s.482 Cr.P.C. is filed by the petitioner/A2 seeking to relax the conditions imposed in the order dated 11.09.2015 passed in Crl.M.P.No.1477 of 2015 in Cr.No. 212 of 2015 on the file of VIII Additional District and Sessions Judge, Vijayawada, wherein the learned Sessions Judge while granting anticipatory bail directed the petitioner to attend before the Station House Officer, Gannavaram Police Station once in every 15 days until the investigation is completed and also to cooperate with the Investigating Officer.
2. Learned counsel for the petitioner submits that the petitioner has been complying with the conditions imposed by the Court since the date of the order. But, however, since he is eking out his livelihood by doing business it has become very difficult for him to attend the concerned Police Station once in every 15 days during business hours.
3. Learned Additional Public Prosecutor opposed the petition contending that since the investigation is pending, the presence of the petitioner is necessary.
4. Having regard to the facts and circumstances of the case; since the investigation is still pending, the condition of petitioner reporting before the Station House Officer, Gannavaram Police Station once in 15 days is modified by directing the petitioner to appear before the said Station House Officer on every alternative Sunday, until further orders, in view of the fact that the petitioner is eking out his livelihood by doing business at Vijayawada.
5. Accordingly, the Criminal Petition is allowed. __________________________ JUSTICE C. PRAVEEN KUMAR 15th March, 2016 vhb
