THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.27187 of 2017 ORDER:

The petitioner was appointed as a permanent fair price shop dealer of shop No.8 of Chetla Mallapuram Village, Kallur Mandal in Kurnool District. While so, the fifth respondent submitted a report alleging certain irregularities against the petitioner and on the basis of the same, the authorization of the petitioner was suspended on 16.03.2015. Thereafter, an enquiry was conducted and the licence of the petitioner was ultimately cancelled by order dated 19.10.2015. Against the said order the petitioner preferred an appeal to the third respondent who confirmed the order of the fourth respondent by orders dated 22.04.2017.

It is stated by the learned Counsel for the petitioner that though the revision was filed before the second respondent along with an application seeking stay, since the same is not disposed of, the present Writ Petition is filed. As could be seen from the papers filed along with the Writ Petition, the revision petition was filed before the second respondent along with the application seeking stay and it was received by the second respondent on 20.05.2017. It is submitted by the learned Counsel for the petitioner that by virtue of the orders in W.P.No.15014 of 2016, dated 28.04.

In the circumstances, if the petitioner is continuing as the fair price shop dealer as on today, the petitioner shall be continued pending disposal of the revision and the second respondent shall dispose of the revision preferred before him as expeditiously as possible, but not later than six months from the date of receipt of a copy of this order.

The Writ Petition is, accordingly, disposed of. It is needless to observe that if alternative arrangements are made during May to July, the same shall be continued and the above interim order does not take effect. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs.
