HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.11797 OF 2017 ORDER:

This writ petition is filed to declare the impugned letter dated 14-05-2010 of the 5th respondent as illegal and arbitrary and consequently direct the 4th respondent to receive and register the documents pertaining to the subject lands.

In similar circumstances, the similar issue has been considered by learned Single Judge of this Court in WP.Nos.35196 and 35198 of 206 by following the judgments in W.A.Nos 1052, 1060, and of dated 09-07-2013.

Heard Sri M.S.Prasad, learned Senior Counsel for the petitioner and Sri B.Prakash learned Standing Counsel for the 5th respondent.

In view of the facts and circumstances of the case, the impugned letter dated 14-05-2010 of the 5th respondent is set aside by following the judgments referred to above. The 4th respondent is directed to receive and register the documents pertaining to subject lands, if the same are in order as per the provisions of Registration and Stamp Act and Rules made thereunder.

Accordingly, this writ petition is allowed to the extent indicated above. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 06-04-2017 Note:
