This writ petition is filed seeking a writ of Mandamus to declare the action of the respondents in not considering the case of the petitioner for promotion to the post of Assistant B.C. Development Officer on the ground of pendency of disciplinary proceedings against him, as arbitrary and illegal. A consequential direction is sought to consider the case of the petitioner for promotion to the post of Assistant B.C. Development Officer in the existing vacancy without reference to the pendency of departmental proceedings initiated against him vide charge Memo Rc.No.BCW1/530/2015, dated 5.1.2016.

Heard Sri S.Satyanarayana Rao, learned counsel for the petitioner and learned Government Pleader for Services-II for the respondents.

The case of the petitioner is that the petitioner is working as Grade-I, Hostel Welfare Officer and is fully eligible and qualified to be promoted to the post of Assistant B.C.
