THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.36376 OF 2015 ORDER:
The grievance of the petitioners is that the police authorities are not providing protection to their property as directed on 03.11.2015 by the learned I Additional Junior Civil Judge, Tirupati, in I.A.No.1101 of 2015 in I.A.No.1014 of 2015 in O.S.No.448 of 2015.
Perusal of the Official Memo dated 04.11.2015 addressed by the Court below to the Station House Officer, M.R.Palli Police Station, Tirupati, reflects that a copy thereof was received by the said addressee as is evident from the stamp and signature thereon.
In that view of the matter, it is not open to the police authorities to delay compliance with the order passed by the competent civil court by claiming that a certified copy of the order has not been produced. In the event the police authorities entertain any doubt as to the genuineness of such an order placed before them by the party, it would be open to them to confirm the authenticity thereof with the court concerned. However, they cannot ignore the direction of the civil court by insisting upon a certified copy being produced which would be a time-consuming process. There shall accordingly be a direction to the first respondent to secure compliance with the afore-stated order passed by the civil court forthwith. The writ petition is disposed of with the above direction. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs.
