HONOURABLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.1514 OF 2019 O R D E R:

The prayer of the petitioner in this case reads as under: "For the reasons stated in the accompanying affidavit, the petitioner herein prays that this Hon'ble Court may be pleased to issue a Writ of Mandamus or any other appropriate Writ and direct the 1st respondent to act in accordance with law and grant No Objection Certificate (NOC) to the petitioner for sale of the loani patta land admeasuring AC.5-00 in Sy.No.72 (72/24) of Battisawargaon Village, Mavala Mandal, Adilabad District and grant such other relief as it deems fit in the circumstances of the case."

According to the petitioner, the land in question was assigned to her under the Loani Patta Rules, 1950, and therefore, the embargo as to alienation by the assignee, which was introduced only thereafter, would have no application to her assignment.

It appears that the petitioner's application dated 17.09.2018 requesting the District Collector, Adilabad, to give clearance to her to sell the assigned land is still pending consideration. That being so, it would not be necessary for this Court to entertain this Writ Petition or adjudicate upon it at this stage. The Writ Petition is accordingly disposed of directing the District Collector, Adilabad, to pass appropriate orders on the petitioner's application dated 17.09.2018, keeping in mind the law laid down by this Court in Letter sent from Plot No.338, Parvant Nagar, Borbanda, Hyderabad and others v. Collector & District Magistrate, Ranga Reddy District at Hyderabad and others1. This exercise shall be completed expeditiously and in any event, not 1 2008 (5) ALT 313

later than eight weeks from the date of receipt of a copy of this order.

Pending Miscellaneous Petitions, if any, shall also stand closed. No order as to costs.
