B/o lur I.A.No.3 of 2025 (Relaxation of Condition Petition) This application under Section 528 of Bharatiya Nagarik Suraksha Sanhita (BNSS), is filed by the petitioner/accused No.1 in Crime No.114 of 2024 on the file of INSP ADMIN (DD) Police Station, Hyderabad, seeking relaxation of condition (iii) as imposed by this Court vide order dated 29.01.2025 in Crl.P.No.801 of 2025.
Heard Mr.
K.N.D.V.Ramana Rao, learned counsel for the petitioner/accused No.1 and Mr. Syed Yasar Mamoon, learned Additional Public Prosecutor appearing for the respondent/State.
Learned counsel for the petitioner submitted that as the petitioner could not surrender before the concerned Station House Officer within the time stipulated in the said order, he filed I.A.No.1 of 2025 and this Court, by order dated 19.03.2025 allowed
the said IA and extended the time for surrender of the petitioner before the concerned Station House Officer till 31.03.2025.
Learned counsel further submits that pursuant thereto, the petitioner has surrendered before the concerned Station House Officer, and as per condition (iii), he has been appearing before the concerned Station House Officer on every Monday between 9:00 a.m., to 5:00 p.m. He further submits that the petitioner being a permanent resident of Kakinada, East Godavari District, Andhra Pradesh, it is very difficult for him to travel from Kakinada to Hyderabad every week and unless the said condition is relaxed, the petitioner would be put to grave hardship. Learned Additional Public Prosecutor has not opposed the same.
In view of the same, condition (iii) as imposed by this Court in order dated 29.01.2025 in Crl.P.No.801 of 2025 regarding the appearance of the petitioner before the concerned Station House Officer on every Monday is relaxed.
All other conditions imposed in the said order remained unaltered.
IA is accordingly disposed of.
